Sources Sought Is Not Yet a Solicitation
Distinguish a federal market-research response from an offer or quotation before scoping capture, teaming or proposal support from a SAM.gov group message.

A Sources Sought notice and a solicitation ask industry for different objects. Sources Sought normally supports market research by requesting capability or market information. A solicitation requests offers or quotations to the Government. The first can justify capture research or a capability response; it does not by itself prove that a proposal competition is open.
This distinction is for a federal capture-consulting partnerships lead watching authorised small-business, agency-market-research and GovCon teaming groups. If the lead sees the message a day late, another adviser may already be helping a company frame its capability response. If the lead calls it a request for proposals (RFP), however, the proposed service, deadline and deliverable can all be wrong.

This is a routing comparison, not a rule that every SAM.gov notice uses identical labels or instructions. The exact official notice controls the requested response.
Definition: the response object marks the stage
FAR 2.101 defines solicitation as any request to submit offers or quotations to the Government. Under sealed bidding, solicitations are invitations for bids. Under negotiated procedures, they are requests for proposals. Simplified acquisition solicitations may request a quotation or an offer.
Market research answers a different question: what products, services and capable sources exist, and what acquisition approach may fit? FAR 10.001 requires market research in specified circumstances before soliciting offers and tells agencies not to request more than the minimum information necessary from potential sources.
FAR 15.201 describes early exchanges with industry, including market research, presolicitation notices, draft requests for proposals and requests for information (RFIs). It states that an RFI may be used when the Government does not presently intend to award a contract but wants price, delivery, market or capability information for planning. Responses to those notices are not offers and cannot be accepted to form a binding contract.
A SAM.gov Sources Sought notice often sits in that market-research family. Read its own language: some notices ask for a capability statement, relevant experience, business size, technical approach or interest in a possible requirement. The response deadline closes that information request. It should not be relabelled as the proposal deadline for a solicitation that does not yet exist.
Example: the same Friday can mean two different decisions
Consider this illustrative composite, not a real agency, contractor, customer message or result:

PWS means performance work statement: a document describing required work and performance outcomes. A draft PWS can help industry understand what the agency is studying. It is not proof that the final scope, competition route or evaluation method has been set.
The first message supplies an agency shorthand, subject, notice label, date and a set-aside prediction. The second supplies a likely response object and draft requirement. Still unknown are the exact notice ID, official instructions, page or format limits, NAICS and size-standard details, acquisition strategy, final set-aside decision, future solicitation number, funding, contracting authority of the participants and whether anyone is buying consulting services.
The capture lead should not answer, “We can write the proposal by Friday.” A better qualification message is:
Please send the exact SAM.gov notice. Does the official page ask for a capability or market-information response, and what sections and format does it name? Has any separate solicitation been issued? We can scope the current response after those records are clear.
That preserves the Friday action without manufacturing a proposal stage.
What to capture for a Sources Sought service request
First recover the nine objects in the SAM.gov notice card: notice ID, type, solicitation number where present, agency, dates, classification, description, package and version. Then add the fields that determine a capability-response scope:
- Requested information. Quote the sections the agency asks respondents to address. Do not add a generic 20-page proposal structure when the notice requests a short capability statement.
- Response method. Record email, portal or other authorised route, file format, page limit, subject line and named contact exactly as the notice states.
- Business identifiers. Capture only the identifiers and representations the notice requests, then let the responding company validate them. A group claim about small-business status is not official evidence.
- Relevant experience. Identify what period, contract size, technical scope or customer type the notice requests. Do not fabricate projects, values or performance.
- Questions and unknowns. Separate assumptions about a future solicitation from facts in the current notice.
This can support a defined commercial deliverable: a source-checked capability-response outline, evidence request and submission checklist. It cannot guarantee that the agency changes the strategy, invites the respondent, sets the acquisition aside or issues a solicitation.
What changes when a solicitation exists
Once an official solicitation is issued, the response object changes. The team must work from current instructions, evaluation criteria, representations, pricing forms, technical requirements, attachments, amendments and submission route. A capability statement may become supporting input, but it is not automatically the proposal.
The service also changes. Proposal support may involve a compliance matrix, colour-team reviews, technical-volume coordination, pricing inputs or portal submission assistance, depending on the actual documents and provider capability. The solicitation-amendment check applies when those documents change after work begins.
Do not use a later solicitation to rewrite the history of the Sources Sought response. Preserve which version existed, what the company sent and what remained uncertain at that time. That record helps the capture team learn without claiming its response caused the agency’s decision.
Why Sources Sought can still be commercially valuable
“Not a solicitation” does not mean “ignore it.” The notice can reveal a named agency problem, capability categories, draft scope, anticipated classifications and the information the agency wants from the market. A qualified adviser may help a supplier decide whether it has relevant evidence, prepare a truthful capability response, find potential teaming gaps or monitor for a later official action.
The value lies in the current decision: whether and how to respond to market research. The unknown future procurement stays unknown.
SAM.gov UEI registration status is a separate readiness check; possessing a UEI does not settle the notice stage or every eligibility condition. The TED notice-stage source route deals with European notices and should not be copied into a US acquisition without the sources above.
